Legal status and tax

Online gambling is legal and licensed under the Glücksspielstaatsvertrag 2021, which for the first time allowed nationwide online slots and poker from 1 July 2021. The GGL, created by the treaty, has acted against unlicensed online offers since July 2022, including payment blocking and IP blocking, and has issued nationwide permits since January 2023. Online casino table games remain a matter for the individual Länder. Under § 22c of the treaty a Land may run them through a state-owned operator or grant a limited number of concessions, no more than its number of land-based casino concessions. North Rhine-Westphalia, for example, allows up to five concessions.

Virtual slot machines and online poker are taxed at 5.3% of stakes under the amended Race Betting and Lottery Act, and sports betting is likewise taxed at 5.3% of stakes. Online casino table games are taxed under the law of the Land that licenses them. North Rhine-Westphalia charges an online casino tax of 30 percent of gross gaming revenue, rising to 55 percent on revenue above EUR 15 million a year.
