Legal status and tax

Online gambling has been legal in the Netherlands since the Remote Gambling Act came into force on 1 April 2021, with the licensed market opening on 1 October 2021. Before that, offering online gambling to Dutch players was prohibited. Land-based casino gaming remains a Holland Casino monopoly and lotteries are separately licensed. Rules in force since October 2024 require personal contact before a high deposit limit and an affordability check above EUR 700 a month. In February 2025 the government proposed raising the age for the riskiest games to 21. In a letter to parliament of 12 June 2026 the State Secretary for Justice and Security chose not to raise the age for now and aims to have a consultation draft of the new online gambling bill ready in the first half of 2027.

Operators pay kansspelbelasting of 37.8% on gross gaming revenue since 1 January 2026, under article 5 of the Wet op de kansspelbelasting. The rate was 30.5% until 2024 and 34.2% in 2025.
